These Terms govern your use of Daily Jolt of Joy (the "Service"). By subscribing or otherwise using the Service, you agree to these Terms. If you do not agree, do not subscribe.
The Service
Daily Jolt of Joy is a free email newsletter sent on weekday mornings, intended for teachers and school staff. The Service is provided at no cost. We may add, change, or remove features at any time.
Eligibility
You must be at least 13 years old and able to enter into a binding agreement in your jurisdiction. The Service is not directed to children under 13.
Your subscription
Provide a valid email address that you own or are authorized to use. You are responsible for the address you submit and for any consequences of providing an address you do not control. You may unsubscribe at any time using the link in any email or by emailing us.
Acceptable use
You agree not to:
- Sign up email addresses you do not own or have not been authorized to add.
- Attempt to disrupt, overload, probe, or reverse-engineer the Service.
- Scrape, mass-download, redistribute, or republish content without permission.
- Use the Service to harass, defame, or harm any person.
Content and intellectual property
Newsletter content is provided for personal, non-commercial enjoyment. You may forward an individual email to a friend or colleague. Any other reproduction, redistribution, or commercial use requires our prior written permission. We retain all rights not expressly granted.
No warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, timely, or error-free.
Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of data, goodwill, or profits, arising out of or in connection with the Service. Our total aggregate liability for any direct damages is limited to USD $50.
Termination
You may end your relationship with the Service at any time by unsubscribing. We may suspend or discontinue the Service, or remove any subscriber, at our discretion and without notice. The "Acceptable use", "Content and intellectual property", "No warranties", and "Limitation of liability" sections survive termination.
Privacy
Our handling of subscriber data is described in the Privacy Policy, which is incorporated into these Terms by reference.
Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
Governing law
These Terms are governed by the laws of the United States and the state in which the operator is principally located, without regard to conflict-of-laws principles.
